Please read these Terms and Conditions carefully before using Envoy Marketplace. By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the Envoy Marketplace application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Nextania Technologies Private Limited (“we”, “us”, or “our”), a company incorporated in India.

2. Eligibility

You must be at least 18 years of age to use Envoy Marketplace. By using the App, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. We reserve the right to terminate accounts of users found to be under 18 years of age.

3. Description of Service

Envoy Marketplace is an AI-powered hyperlocal buy and sell platform that connects buyers and sellers within local communities across India. The App uses artificial intelligence agents to facilitate listing creation, photo moderation, buyer-seller matching, and contact sharing. Envoy Marketplace acts solely as a platform and is not a party to any transaction between buyers and sellers.

4. User Accounts and Registration

4.1 To use the App, you must register with a valid Indian mobile phone number. Your phone number will be verified via a one-time password (OTP).

4.2 You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4.3 You agree to provide accurate, current, and complete information during registration, including your full name, phone number, and district of residence.

4.4 We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or misleading.

5. Prohibited Items and Content

5.1 The following items are strictly prohibited on Envoy Marketplace and may not be listed, offered, or sold under any circumstances:

• Drugs, narcotics, cannabis, cocaine, heroin, or any controlled substances
• Weapons, firearms, ammunition, explosives, or any related accessories
• Prescription medicines, over-the-counter controlled substances, or any pharmaceutical products
• Alcohol, liquor, wine, beer, spirits, or any intoxicating beverages
• Tobacco, cigarettes, cigars, hookah products, vape products, or e-cigarettes
• Counterfeit goods, pirated content, or items that infringe intellectual property rights
• Stolen goods or items obtained through illegal means
• Human organs, body parts, or any human trafficking related content
• Pornographic or sexually explicit material
• Any item whose sale is prohibited under applicable Indian law

5.2 Our AI agent actively screens all listing attempts. Any attempt to list prohibited items will be automatically rejected.

5.3 Users found attempting to list prohibited items will be permanently banned from the platform without notice or refund.

6. User Conduct

6.1 You agree to use the App only for lawful purposes and in accordance with these Terms.

6.2 You agree not to:

• Post false, misleading, or fraudulent listings
• Harass, abuse, or harm other users
• Attempt to circumvent our AI moderation systems
• Use the App for any commercial spam or bulk messaging
• Attempt to hack, disrupt, or interfere with the App’s infrastructure
• Impersonate any person or entity
• Collect or harvest other users’ personal information without consent

6.3 All transactions conducted through the App are solely between the buyer and seller. You agree to conduct yourself honestly and in good faith in all transactions.

7. Contact Sharing and Consent

7.1 Envoy Marketplace uses a bilateral consent system for contact sharing. Your phone number will never be shared with another user without your explicit approval.

7.2 When a buyer expresses interest in your listing, you will receive a notification and must actively consent before your contact details are shared.

7.3 By consenting to share your contact details, you acknowledge that the other party will be able to contact you directly outside the App.

7.4 We are not responsible for any communications, transactions, or disputes that arise after contact details have been shared between users.

8. Meeting PIN and Ratings

8.1 After a transaction, both buyer and seller are issued a unique Meeting PIN to confirm that a physical meeting took place.

8.2 Ratings are only unlocked after both parties exchange and verify their respective PINs, ensuring that all reviews reflect genuine real-world experiences.

8.3 You agree to provide honest and accurate ratings. False or malicious ratings may result in account suspension.

9. Subscriptions and Payments

9.1 Envoy Marketplace offers a free trial period with limited listing credits. After the trial period, continued use of listing features requires an active subscription.

9.2 Subscription plans are offered at the following tiers:

9.3 All payments are processed securely through Google Play Billing. We do not store your payment card details.

9.4 Subscriptions automatically renew at the end of each billing period unless cancelled.

9.5 Refunds are governed by Google Play’s refund policy. We do not offer independent refunds outside of what Google Play permits.

9.6 We reserve the right to modify subscription pricing with reasonable notice to users.

10. AI Moderation and Photo Review

10.1 All photos uploaded to the App are reviewed by our AI moderation system before publication. Photos that contain prohibited content, inappropriate material, or content unrelated to the listing will be rejected.

10.2 We reserve the right to remove any listing or photo that violates these Terms, even after publication, without prior notice.

10.3 Our AI moderation system is designed to assist but may not be perfect. Users are ultimately responsible for the content they submit.

11. Intellectual Property

11.1 The App, including its design, code, features, and content, is owned by Nextania Technologies Private Limited and is protected by applicable intellectual property laws.

11.2 You retain ownership of the content you post on the App, including listing descriptions and photos. By posting content, you grant us a non-exclusive, royalty-free licence to use, display, and distribute your content within the App for the purpose of operating the service.

11.3 You represent that you own or have the necessary rights to all content you post and that such content does not infringe the rights of any third party.

12. Disclaimer of Liability

12.1 Envoy Marketplace is a platform that connects buyers and sellers. We are not responsible for the quality, safety, legality, or availability of any item listed on the App.

12.2 All transactions are conducted at the sole risk of the buyer and seller. We strongly encourage users to meet in safe, public locations and to verify items before completing any transaction.

12.3 We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App or any transaction conducted through the App.

12.4 We do not guarantee the accuracy of any listing, description, photo, or rating posted by users.

13. Privacy

Your use of the App is also governed by our Privacy Policy, available at: https://nextania.in/envoy-privacy-policy/. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

14. Account Termination

14.1 You may delete your account at any time by contacting us at nextaniatechnologies@gmail.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

14.2 We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice or liability.

14.3 Upon termination, your right to use the App ceases immediately. Any active subscription will not be refunded except as required by Google Play’s refund policy.

15. Governing Law and Dispute Resolution

15.1 These Terms shall be governed by and construed in accordance with the laws of India.

15.2 Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
