These Terms of Service (“Terms”) govern your access to and use of MailMind (“the Service”), operated by Nextania Technologies Private Limited (“Nextania”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using MailMind, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you do not agree, do not use the Service.
2. Description of Service
MailMind is an AI-powered email reply assistant that:
- Connects to your Gmail account via Google OAuth
- Displays your inbox emails within the MailMind interface
- Uses OpenAI’s GPT-4o model to compose professional email reply drafts
- Sends replies via Gmail API only upon your explicit instruction
The Service is a productivity tool. All email sending actions require your manual approval by clicking the Send button.
3. User Responsibilities
You agree to:
- Provide accurate information when registering
- Maintain the security of your Google account credentials
- Use the Service only for lawful purposes
- Not use the Service to send spam, unsolicited emails, or harassing messages
- Review all AI-generated replies before sending them
- Accept responsibility for all emails sent through your account via the Service
You acknowledge that AI-generated replies are drafts and may not always be accurate, appropriate, or complete. You are solely responsible for reviewing and approving content before sending.
4. Intellectual Property
The Service, including its design, code, and branding, is owned by Nextania Technologies Private Limited and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.
5. Third-Party Services
The Service integrates with third-party platforms including Google Gmail API and OpenAI API. Your use of these integrations is subject to their respective terms of service. Nextania is not responsible for the availability, accuracy, or actions of these third-party services.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NEXTANIA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. USE OF THE SERVICE IS AT YOUR SOLE RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXTANIA TECHNOLOGIES PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR DAMAGE TO REPUTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Indemnification
You agree to indemnify and hold harmless Nextania Technologies Private Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by signing out and revoking Google permissions.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
